A PSV operator licence suspension means the operator must stop using vehicles under the authority of the suspended licence from the date and time stated in the decision. Finding a new transport manager does not cancel a suspension. The immediate priorities are to comply with the decision, preserve any appeal or stay deadline, obtain specialist operator-licensing advice and start correcting the failures identified in the evidence.

If the Commissioner Has Proposed Action
A proposal to suspend, revoke or curtail should state the grounds, response method and deadline. Under section 17 of the Public Passenger Vehicles Act 1981, an operator can require an inquiry before the specified action is taken by requesting one within the period allowed. The operator should obtain the disclosed evidence, answer the letter in time and take advice on whether to request or waive the hearing.
The response needs to address the statutory ground actually relied on. Maintenance records, financial standing and professional competence are different tests. An external transport manager may be relevant to one or more of them, but no private appointment repairs a brake-testing history or proves financial standing.
When Transport Manager Support Is Relevant
A standard PSV licence needs professional competence throughout its life. The nominated transport manager must exercise continuous and effective management, not simply lend a CPC certificate to the business. If the manager resigns, becomes unavailable or is removed, the change must be reported and the operator may need a replacement nomination and a period of grace.
Transport manager concerns can also arise while a name remains on the licence. Warning signs include contracted hours that no longer match the fleet, little contact with the operating centre, no evidence of maintenance or drivers’ hours review, and insufficient authority to stop a vehicle or require corrective work. The Senior Traffic Commissioner’s Statutory Document No. 3 sets out the matters considered when assessing whether the role is genuine.
A Period of Grace Is Discretionary
Where no authorised transport manager is in place, a traffic commissioner can allow up to six months to recruit a replacement. A further three months may be available following the death or physical incapacity of the previous manager. The published starting point is normally three months, with any longer period decided on the facts.
The request needs tangible evidence that the time will be worthwhile. Recruitment activity, a credible candidate, a complete nomination and a workable plan for managing the operation are relevant. The commissioner is not obliged to grant the request, and the replacement must be approved before the period expires. An interim external manager can be part of that plan, but engagement through the platform is not regulatory approval.
What a Qualified Manager Can Work On
The work depends on the findings. A suitable manager may review the safety inspection planner, defect reporting, rectification, brake performance evidence, drivers’ hours, tachograph downloads, vehicle-off-road controls, safety recalls and audit trail. The current DVSA Guide to Maintaining Roadworthiness is the baseline for vehicle maintenance systems.
For passenger carrying vehicles, braking performance must be assessed at every safety inspection. The guide expects an unladen roller brake test at every inspection. A risk-assessed decelerometer route is available in appropriate circumstances, with at least four roller brake tests spread evenly through the year. The records must show what was tested, when, and what happened to any defect.
The manager can identify and implement work within their competence, record decisions and report to the operator. They cannot promise the outcome of a public inquiry or replace the need for legal advice where an appeal, stay or disputed regulatory finding is involved.
A Published PSV Case Shows the Distinction
In the February 2026 Supreme Minibuses Limited decision, DVSA found brake performance evidence missing from all 14 inspection reports reviewed, excessive inspection intervals and weak driver defect reporting. The traffic commissioner imposed a one-week suspension, removed the transport manager and granted a period of grace for a replacement. The operator also accepted training, independent audit and brake-testing undertakings.
The decision did not treat a proposed new manager as a complete answer. Recent maintenance evidence and the operator’s wider actions were considered separately. That is the practical lesson: transport management can support a compliance rebuild, but the evidence must cover every finding in the case.
If a Decision Has Already Been Made
Do not continue operating under a suspended licence unless and until an effective stay permits it. An appeal does not create a stay automatically. The notice of appeal must normally be received by the Upper Tribunal within one month of the date the decision was sent. A stay request should be made immediately to the commissioner who made the decision and can be renewed to the Upper Tribunal if refused. The procedure is explained in Statutory Document No. 12.
