Risk register entry three: the wrong legal assumption

Risk: the operator treats an external appointment as a transfer of responsibility. Statutory Document 3 on GOV.UK explains that standard national and standard international goods vehicle operator licences require a professionally competent Transport Manager to be nominated. A restricted goods vehicle licence holder is not required to nominate one, but remains responsible for compliance. The operator remains responsible for licence compliance and the nominated Transport Manager must exercise continuous and effective management.
